1. Accepting these terms
These Terms of Service ("Terms") are a binding agreement between you and LettersSay ("we", "us"). By using letterssay.com or any game or tool on it, you agree to them. If you do not agree, please do not use the site.
You must be at least 13 years old to use LettersSay (16 in the EEA and UK). If you are under the age of majority where you live, you may use the site only with the involvement of a parent or guardian.
2. What LettersSay is
LettersSay is a free collection of word games and word tools. We provide it "as is" and may add, change, suspend or remove games, features or pages at any time. We are not affiliated with, endorsed by, or sponsored by Hasbro, Mattel, Scrabble, Words With Friends, Zynga, Wordle, The New York Times, or any other game publisher. Trademarks belong to their owners and are referenced only descriptively.
Word validity is based on public word lists. Dictionaries disagree, and tournament rules vary. Our results are for reference and entertainment; they are not an authority for competitive play.
3. Accounts
No account is required to play. If you create one, you agree to give accurate information, keep your password secure, and accept responsibility for activity under your account. Tell us promptly at legal@letterssay.com if you suspect unauthorised use. One person, one account. You may delete your account at any time.
4. Acceptable use
You agree not to:
- Break the law, or use the site to harm, harass, threaten or defraud anyone
- Submit falsified scores, manipulate leaderboards, or use bots, scripts or automation to play
- Scrape, crawl or bulk-download the site beyond ordinary personal use, or ignore our
robots.txt - Attempt to breach, probe, overload or disrupt the site, its infrastructure or its security controls
- Reverse engineer or copy the site to build a competing service
- Interfere with advertising, or misrepresent your identity or affiliation
- Upload malware, or choose a display name that is obscene, hateful, or impersonates someone else
5. Fair play and leaderboards
Scores are validated on our servers. We may reject, remove or adjust any score we reasonably believe to be falsified or obtained by automation, and we may remove a user from leaderboards or terminate an account for repeated or serious violations. Leaderboards are entertainment; they carry no prize or monetary value unless we say otherwise in writing.
6. Pro subscriptions and refunds
Pro is an optional paid tier billed on a recurring basis at the price shown at checkout, through our third-party payment processor. Key terms:
- Auto-renewal. Your subscription renews automatically each period until you cancel.
- Cancelling. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you keep Pro access until then.
- Refunds. Payments are generally non-refundable except where required by law. If you have a billing problem, contact us within 30 days and we will deal with it in good faith.
- Statutory rights. Consumers in the EU, UK and other jurisdictions may have a statutory cancellation or withdrawal right. Nothing here removes it.
- Price changes. We will give at least 30 days' notice before a price change takes effect, and you may cancel before it applies.
7. Intellectual property
The LettersSay name, logo, design, original text, and game code are ours and protected by intellectual property law. You may not copy, redistribute or create derivative works from them without written permission. You may of course share links, screenshots and your own results.
Word lists and definitions come from third-party sources under their own licences, including material derived from Wiktionary under CC BY-SA 3.0 and name data from Behind the Name under CC BY-SA 4.0. Those licences continue to apply to that material.
If you believe content here infringes your copyright, send a notice with the required details to legal@letterssay.com and we will respond promptly.
8. Third-party content and links
The site displays advertising and links to third-party sites we do not control. We are not responsible for their content, products or practices. Dealings with advertisers are between you and them.
9. Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the site will be uninterrupted, secure or error-free, or that word data will be accurate, complete or accepted in any particular game or tournament.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR GAME PROGRESS, ARISING FROM YOUR USE OF THE SITE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Indemnification
You agree to indemnify and hold us harmless from claims, damages and reasonable legal costs arising out of your misuse of the site or your breach of these Terms or of any law or third-party right.
12. Termination
You may stop using the site or delete your account at any time. We may suspend or terminate access if you breach these Terms, or if we discontinue the service. Sections that by their nature should survive termination โ intellectual property, disclaimers, liability, indemnity and dispute resolution โ do survive.
13. Dispute resolution and arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to participate in a class action.
13.1 Informal resolution first
Before starting any formal proceeding, you agree to contact us at legal@letterssay.com and give us 60 days to resolve the dispute informally. Most problems can be sorted out this way.
13.2 Agreement to arbitrate
If we cannot resolve it informally, you and we agree that any dispute arising out of or relating to these Terms or the site will be settled by binding individual arbitration rather than in court, except as stated in 13.4. Arbitration will be administered by a recognised arbitration provider under its consumer rules, before a single arbitrator, and may be conducted by telephone, video, or written submissions where the rules allow.
13.3 Class action waiver
You and we agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims. If this waiver is found unenforceable as to a particular claim, that claim โ and only that claim โ will proceed in court.
13.4 Exceptions
Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property or stop unauthorised access.
13.5 Your right to opt out
You can opt out of this arbitration agreement. Email legal@letterssay.com with the subject "Arbitration Opt-Out" and your account email within 30 days of first accepting these Terms. Opting out will not affect your use of the site in any other way, and we will not treat you differently for doing it.
13.6 Consumers outside the United States
If you are a consumer in the EEA, UK, or another jurisdiction whose law guarantees you access to local courts, this arbitration section does not deprive you of that right, and you may bring proceedings in the courts of your country of residence. Mandatory consumer protections of your home country continue to apply.
14. Governing law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-law rules. Subject to the arbitration agreement in section 13, the state and federal courts located in North Carolina have exclusive jurisdiction over any dispute not subject to arbitration. This choice of law and venue does not override mandatory consumer protection rules of your country of residence.
15. Changes to these terms
We may update these Terms. We will change the date at the bottom of this page and, for material changes, give reasonable advance notice. Continuing to use the site after changes take effect means you accept them. If you do not accept, stop using the site and delete your account.
